Many charged with a DUI / DWI in Marin County, Contra Costa County or San Mateo County, are unaware of the legal limits and the consequences for a DUI in California.  In California the rules are as follows:

    1. the BAC (blood alcohol content) defined as illegal is anything over 0.08 percent
    2. the administrative license suspension for a first time offense is four months
    3. driving privileges may be restored during license suspension after 30 days
    4. an ignition interlock device may be attached to the vehicle
    5. vehicle forfeiture may be included
    6. open container laws apply to both the driver and the passenger
