In Florida, it is illegal to drive a vehicle while your normal faculties are impaired. Typically law enforcement officers will try to determine impairment by using one or more of three distinct methods.
The first and most obvious method is the driving pattern. Factors such as speed, lane control, weaving, and tracking, are all components of an officer finding an over-all ÒDriving PatternÓ that may indicate that the driver is impaired.
The second method used by officers is the ÒField sobriety taskÓ or more often, tasks. This is the physical testing conducted by an officer on the scene. A poor performance on the field sobriety tasks may also indicate to an officer that a driver is impaired.
The third method for determining impairment is the Intoxilyzer Instrument. Florida Law allows for a jury to presume a person was impaired if they have a .08 BAL as measured by this device.

In Florida the DHSMV will also take interest in your DUI charge.
Upon arrest your driving privilege will be suspended for some period of time, unless you win an evidentiary hearing before a DHSMV hearing officer.
