DUI—A cultural stigma has become associated with drunk driving that was not present in our society a few decades ago.  Publication of exaggerated and misleading statistics has resulted in kind of a mass hysteria that stigmatizes people charged with drunk driving as criminals, even before they have been convicted of any crime. Being arrested for drunk driving or driving under the influence (DUI) can be an unsettling proposition, to say the least. A DUI  conviction in Florida carries with it heavy penalties, including:

    • Mandatory Adjudication resulting in a permanent criminal record
    • Mandatory Suspension or Revocation of license, both administrative, for failing or refusing breath, blood or urine tests, and as a result of conviction for DUI.
    • Mandatory Probation for at least one year with special condition prohibiting the possession or consumption of alcohol.
    • At least 50 hours of Community Service
    • Possible jail or prison time, including mandatory jail for second and subsequent offenses within 5 or 10 year periods, respectively.
    • Mandatory alcohol education for at least 12 hours followed by assessment and treatment if recommended (an 85% statistical probability)
    • Mandatory Vehicle immobilization or forfeiture
    • Serious fines and court costs, from over $500 to $5,000.00

    Collateral consequences usually include:

    • Possible job loss
    • Increased insurance rates
    • Social stigma

If you have been arrested or accused of drunk driving, DUI, DUI with serious bodily injury, DUI manslaughter, vehicular homicide, or any other alcohol-related criminal offense, you are probably frightened, confused, and concerned about your future and that of your family. Under Florida law, you have only ten days (10) to challenge the administrative suspension of your license.  This is a critical phase of discovery as well as the chance to get your driving privileges back. The selection of an experienced attorney is the first step towards regaining control of your life.
