Beverly Drunk Driving Lawyers
- Gabriel, David:
There are many viable defenses to a DUI: improper administration of
roadside tests, the arresting officer's subjective conclusions, and the
inaccuracy of breathalyzer machines. Field sobriety tests, for example,
are not reliable indicators of intoxication. Especially when asked to
perform them at night, on the shoulder of the road, in the cold, in the
glaring squad car headlights.
* Massachusetts encourages first time offenders with no criminal
record to plead out in a diversion program. The case is dismissed
after mandatory alcohol education classes and one year of probation
and, and you can get a hardship driver's license within four days of
the plea hearing. * A second DUI is harsher, and often requires
going to trial. A second offense is punished by a minimum of two
weeks in an alcohol facility and a 60-day suspended sentence,
two-year license revocation with no hardship license for six months.
* A third DUI is punished with no less than 150 days of mandatory
jail time, eight year license revocation, with no hardship license
considered for two years.
- Joseph Waldbaum:
Under the new Massachusetts law, an OUI can now follow you the rest of
your life. Due to these increasingly complex laws, OUI defense has
become a specialty.
