is about damage control. Allow your attorney to help you
put your best foot forward. For cases that are plead and
not tried, much of the work takes place between the first meeting with
your attorney and prior to the Pre-trial.
Adequate
preparation can save you money, loss of freedom and loss of privileges
such being able to drive or go to
work.
The following are some potential opportunities under which your attorney may be able to reduce the damage of the plea:
Advisement Pleas- Available for first time offenders for many misdemeanor criminal matters (other than drunk driving cases)
Holmes Youthful Trainee Act-For first time offenders between ages 17 and 21 (some crimes are excluded)
Domestic
Violence Advisement- First time offenders, with specified relationships
to the victim, may be placed on probation without entering a judgment
of guilt
Controlled
Substances Diversion-For first time offenders, with a specified
possession or use amount, the charge may be under advisement for no
greater than a year while the offender completes the terms and
conditions of the probation. Successful completion of the
terms and conditions results in charges being dismissed.
Delayed
Sentencing-delayed sentencing for up to one year to determine
eligibility for probation and during which time the offender attempts
to redeem himself or herself.
Work Release-The offender is eligible to leave jail to work.
Tether (Home Confinement) ˆAlternate to jail with restrictions on the offenderˆ‚s
Ability to leave home such as for work, health reasons.
