Why you should (politely) refuse a preliminary breath test (PBT).
by Josh Blanchard
In most states, it is common for the police to request that you submit to a preliminary breath test during the course of a drunk driving ÒinvestigationÓ. In Michigan, most people are best advised to refuse the test.
What is a preliminary breath test (PBT)?
A PBT is a small handheld device that attempts to measure blood alcohol content by measuring the alcohol contained in your breath as you exhale into the PBT. To do this, most PBTs make use of a fuel cell that oxidizes the alcohol in your breath as it passes over the fuel cell. This oxidation process alters the electrical current flowing through the device and it attempts to calculate your blood alcohol content based on this change in electrical current. Generally speaking, the results of a PBT are not admissible to prove the amount of alcohol in oneÕs body in a trial for driving under the influence.

- Papadopoulos, Dino:
Operating a Motor Vehicle While Intoxicated/ While Impaired covers most of the basic aspects of
Michigan's drunk driving laws. Of course, there are more aspects to a case than the definition of the crime and the possible sentence.
WHETHER YOU DO OR DO NOT TAKE THE BREATH TEST ADMINISTERED BY POLICE, YOU NEED TO BE AWARE OF THE PROCEDURAL ASPECTS OF YOUR CASE, SUCH AS THE FOLLOWING:
Arrest Without Warrant- Preliminary Chemical Breath Analysis Consent to Chemical Tests Refusal To Submit to Chemical Test Request for Hearing after Refusal to Submit to Chemical Test Hearing Procedure Requirements for Police Office after Refusal to Submit or After Unlawful Blood Alcohol Found
IT IS CRUCIAL THAT YOU KNOW YOUR RIGHTS UNDER THE ABOVE LAWS. TIME IS OF THE ESSENCE, AND IGNORANCE OF THE LAW OR THE INABILITY TO COMPREHEND THE REQUIREMENTS WILL NOT OFTEN BE OVERLOOKED.
Some of the court dates you will be facing are described in the following law: Arraignment and Pretrial Procedure
Sometimes, in a very limited number of cases, people might be able to resolve a case through the less serious charges defined below: Reckless Driving Careless or Negligent Operation of Vehicle as a Civil Infraction
WHAT HAPPENS TO MY LICENSE?
Generally, for Driving While Intoxicated, your license will be suspended for 180 days. However, after 30 days, you may petition for a retricted license, which will allow you to drive under certain conditions. For Driving While Visibly Impaired, your license will be suspended for 90 days. Your eligibility for a restricted license starts immediately, but you may still be denied one. For Driving While Under the Influence of a Controlled Substance, your license will be suspended for 180 days, with eligibility to request a restricted license after 30 days. Suspension of license for first time offenders THESE PENALTIES ARE HIGHER IF YOU HAVE A PRIOR HISTORY! NEVER ASSUME YOU KNOW EXACTLY WHAT WILL HAPPEN TO YOUR LICENSE. WORD OF MOUTH FROM A FRIEND OR RELATIVE MAY BE INACCURATE.

- Trainor, Christopher:
Drunk driving can be legally defined in several ways. The most common definitions include:
* DUI - Driving Under Influence
* DWI - Driving While Intoxicated
* OWI - Operating While Intoxicated
* OUI - Operating Under Influence
* OMVI - Operating Motor Vehicle While Intoxicated
Many casual drinkers often think that they can still drive after a few drinks, but in most cases they are wrong. Acceptable Blood Alcohol Concentration (BAC) levels vary across states. In Michigan, for example, the limit is set at a .08 BAC. It only takes 3 drinks to reach that level.
As you can see, it doesn't take many drinks to impair your driving ability and send you over the legal limit. In fact, it might even take fewer drinks to reach the limit depending on your weight and size. If you have recently received a DUI, It is important that you know your rights.
- Moore, Scott:
OPERATING WHILE INTOXICATED (OWI) - Operating while intoxicated (OWI), also known as driving under the influence of alcohol (DUI), driving while intoxicated (DWI), or drunk driving , is an increasingly common social problem in today's world. Throughout the state of Michigan and in all other jurisdictions across the United States, it is considered a serious offense and can lead to severe criminal penalties, including heavy fines, loss of driving privileges, and incarceration. The authorities in many states are currently cracking down on DUI offenses by reducing the blood alcohol content level at which a person can legally operate a motor vehicle. However, knowledgeable legal counsel can help you avoid hefty fines, license suspensions, or large insurance increases.

Before you even consider pleading guilty to a drunk driving charge, you
should find out if you have a valid defense that could result in a
dismissal or a plea bargain.
