- Bertram, Karl:
Traffic Violations Most traffic violations are considered minor criminal
offenses. Even minor mechanical or speeding violations can have serious
consequences, leading up to your license being suspended if you have
several infractions over a short period of time. Frequently, you will
have to pay the fine listed on the face of the ticket, and there is also
a strong possibility that your vehicle insurance premiums will increase.
DUI / DWI Driving While Intoxicated ("DWI") is considered a serious
crime in every state. DWI and Driving Under the Influence ("DUI") refer
to the same crime. Drinking alcohol or taking drugs may affect your
ability to operate cars, boats or industrial equipment in a safe manner.
It is against the law in every state to drive under the influence of
alcohol or drugs.
Felonies Felonies are any of several grave crimes such as murder, rape
and burglary, for which a punishment greater than that of a misdemeanor
is provided. Such a crime may carry extensive jail time and fines.
Felony cases are not handled in a District Court, but rather bound over
to the Circuit Court.
Misdemeanors Misdemeanors are "lesser" criminal acts which are generally
punished less severely than felonies but more so than infractions.
Depending on the jurisdiction, examples of misdemeanors may include
petty theft, prostitution, simple assault, trespass, vandalism, and the
like. In general, misdemeanors are crimes with a maximum punishment of
one year or less of imprisonment.
Juvenile Law Many of the offenses for which young adults under the age
of eighteen are charged are similar to adult crimes, ranging from
traffic misdemeanors to violent felonies.

Driver's License Suspension After a DWI Arrest
A DWI arrest will involve the criminal case as well as a civil case involving driver's license suspension. If you have been charged with DWI, you have 15 days to challenge your driver's license suspension.
If you refused the Breathalyzer test, you have 30 days to challenge the suspension of your driver's license. The first and second DWI offenses carry suspension for up to 90 days. Subsequent offenses result in suspension from a year to 10 years.
- Brandi Morris:
A driver's license is essential to our way of life, but a drunk-driving conviction or one too many speeding tickets can mean your license is suspended for months. If you have been charged with drunk driving, don't plead guilty until you have spoken with an attorney. You may have an effective defense, or I may be able to minimize the damage to your driving record.
- Ronald Jurgeson:
The filing of any criminal charge against you is a serious matter.
Don't try to challenge the government alone. You need an attorney
experienced in these matters.
- Earnshaw-Hobbs Law
Office:
You may be fined up to $500.00 if you received your ticket from a city court or up to $1,000 if you received a
State ticket (in addition to any jail time the court may impose). You will also be required to attend the SATOP
screening and one of the alcohol schools and the Victim Impact Panel (or VIP) program. AND you may be
required to be on supervised probation (to keep out of the jail time that may be imposed) at a cost of
anywhere from $12.00 to $20.00 per month for up to 24 months.
DUI, Traffic Tickets & Criminal Law
IF YOU ARE STOPPED FOR A DUI or TRAFFIC VIOLATION:
DO be polite and produce the requested documents.
DO NOT say that itŐs your fault, even if you think it is.
DO NOT volunteer information. You are not required to answer ANY questions regardless of what the officer says.
DO NOT lie to the officer. If you donŐt want to answer a question, itŐs better just not to answer than to lie.
