Basking Ridge DWI Lawyers
- D'Alessandro & D'Alessandro:
New Jersey drunk driving laws are tough and the penalties for a drunk driving conviction can extend well beyond the initial punishments you receive. A DWI conviction can cause you to lose your driver's license and pay higher insurance rates. Do not take any chances with your freedom or your future.
Penalties for DUI/DWI
The penalties and costs of a driving while intoxicated (DWI) conviction in New Jersey may include:
* Expensive court costs and fines
* Ignition interlock devices
* The possibility of jail time
* Community service
* Higher insurance premiums
* Driver's license suspension
* Lost jobs and other future opportunities
* Points on your driving record
- Mark, Jamison:
For all cases in the Municipal courts of New Jersey, you have the following rights:
* The right to know the accusation against you;
* The right to remain silent concerning your accusation (remember, anything you say may be used against you)
* The right to retain an attorney
* The right to prepare a defense and subpoena witnesses to testify on your behalf
* The right to testify or not testify on your behalf ("pleading the fifth"). A decision not to testify cannot be used against you
* The right to a trial
At Municipal Court, you will not have a jury trial. Your case will be heard before a judge. At the Superior Court level, or if you have been indicted, you are entitled to a jury trial. It is the state’s burden to prove beyond a reasonable doubt that you committed the crime as charged. If the state does not meet its burden, the judge will determine that you are not guilty.
- D'Alessandro &
D'Alessandro:
Traffic violations can have serious criminal consequences, particularly
when a driver is accused of driving under the influence. A conviction
on DUI/DWI charges will result in fines and possibly land you in jail.
In addition, your insurance company may increase your rates to an
unmanageable level. In defending against an impaired driving charge,
you have many rights as a criminal defendant, including the right to
cross-examine the witnesses against you, even if they are police
officers. An experienced attorney can make all the difference in such a
difficult case.
