What to Do When Pulled Over
Contrary to what you may have heard, if you are pulled over for suspicion of DWI, you are not required to consent to a field sobriety test. However, you are required to submit to a breathalyzer test if it is your first offense. If you refuse, your license will be suspended for six months even if you are acquitted at trial.
The penalties you face increase with each DWI conviction. A third DWI conviction is considered to felony DWI and will leave you facing prison time. For this reason it is extremely important to fight every DWI charge against you to avoid a cumulative effect. Whether you have been pulled over for the first time or face felony DWI charges, I will work closely with you to determine your best course of action.
Drug Related DWI Offenses
Usually involving driving while under the influence of marijuana, a conviction for drug-related DWI has similar consequences as DWI related to drunk driving. Before you are arrested, police will have a drug recognition expert determine whether you have used marijuana. After your arrest they will test you for drug use.
