- Pardo, Renee: Penalties for a DWI can be severe. Punishment can include driver's license suspended or revoked, expensive fines and/or jail. A first DUI offence in the state of New York can result in a fine of $500 and/or 15 days imprisonment. A second offense within 5 years of the first can be punished by $750 in fines and 30 days in jail. A third conviction within 10 years is a misdemeanor and can result in a $1500 fine and 180 days in prison. Multiple DWI convictions can result in felony DWI charges. Felony charges are also brought against first time offenders if there were injuries or deaths due to a car accident involving drunk driving. An officer will request a suspected drunk driver to submit to a breathalyzer, intoxilyzer or other field test upon pulling that driver over. A driver whose blood alcohol concentration (BAC) is 0.08% or higher can be charged with misdemeanor DWI. If the BAC is excessively high or there are other severe traffic violations involved, the driver can face "aggravated DWI" charges. A refusal to take a test can result in an immediate license suspension.
