  1. Siegel, Stephan: The New York State Vehicle and Traffic law defines permissible and non permissible behavior on the road (and off as well). There are numerous crimes chargeable as traffic crimes in New York. These crimes involve all sorts of prohibited behaviors, including vehicular assault and manslaughter, drunk driving (either driving while intoxicated or impaired by the use of alcohol), driving while impaired by chemical substances other than alcohol, driving with a revoked or suspended license, reckless driving, speeding, driving on the wrong side of the road or even playing your stereo too loudly. Substance and alcohol traffic related offenses can be prosecuted as either misdemeanors or felonies. They require the skillful representation of talented lawyers. If you have alcohol in your blood and you cause either an injury to person or property or a death, you will be prosecuted and face stiff sentences even if you were not negligent. If you are arrested or charged with a traffic offense, you should contact a lawyer experienced in traffic related offenses so that your rights can be protected as well as possible.

Any DWI (DUI, drunk driving) charge should be considered serious. If an accident was involved or if this is your second DWI in a 10-year period, the charge can be even more serious. If you have been arrested for DWI, you need an experienced lawyer to guide you through the criminal justice process and to protect your rights and interests.

    Arrested for DWI?

DWI charges involve both administrative issues (loss of driving privileges) and criminal issues. Every arrest is different.

    1. Were you stopped because of the way you were driving?
    2. Was there an accident involved?
    3. Did the accident cause property damage?
    4. Did the accident cause injuries?
    5. Was this your first DWI? Was it your second DWI in 10 years?
    6. Did you refuse a blood test?
    7. If you took a blood test, what were the results?

A DWI charge can change your life. You could face loss of driving privileges, court fines, increased insurance costs, drug and alcohol treatment programs, community service, and even jail time. Make sure your rights are protected as soon as possible.

  7. Gary DiLeonardo: If you have just been arrested for Driving Under the Influence (DUI)/Driving While Intoxicated (DWI) for the first time, you may feel uncertain about the resulting court proceedings. Unfamiliar with the criminal justice system, you may consider having a Òfriend of a friendÓ or your familyÕs lawyer represent you on the charges. This may be a critical mistake. DUI/DWI law can be quite complex. Furthermore, the stakes are highÑeven as a first time offender, you may face hefty fines, probation, revocation of your license and a dramatic rise in your automobile insurance rates. You may even be sentenced to some jail time. Therefore, it is important to hire a defense attorney who has experience in this area of law.
  8. Murray Singer: The police are not required to read you any Miranda rights ("You have the right to remain silent. Anything you say can and will be used against you. . . .). The Miranda rights are required only if the police or prosecutor want to use what you say against you in court. The rights were developed to make sure that a person knows that he or she does not have to talk to the police, and thus to make sure that any statements made to the police are made voluntarily. In practice, the police often do not tell the truth about having given the rights, or read them to you in a way that makes you think that you have to talk. You should NEVER talk to the police without first contacting a lawyer.
