If that test indicates that you have consumed alcohol the police officer can ask you to submit to a chemical test. Other Potential Fees, Charges and Consequences: In addition to the fines stated in the above charts, if convicted you will have to pay a mandatory surcharge and crime victim assitance fee between $260 and $520. You will also be charged a Driver Responsibility Assessment Fee by the New York State Department of Motor Vehicle totaling seven hundred and fifty dollars over three years. If your license is suspended you will have to pay a suspension termination fee to get your license back. If your license is revoked you will have to pay a re-application fee before applying for a new license. A conviction may also result in suspension or revocation of your registration. You may have to pay a fee to re-register your vehicle. You may also be required to pay a fee for attending a Victim Impact Panel. You may have to pay a fee to get a conditional license. You may also have to pay a fee to enroll in the Drinking Driver Program [ $75.00 to NYSDMV + up to $225.00 to the course provider =$300.00]. You may also be required to pay for a drug or alcohol evaluation and/or treatment program. You may even have to purchase an ignition interlock system. You also probably be required to pay a higher premium for car or life insurance. You could even be excluded from certain employment opportunities. You may lose your right to vote or your ability to be a notary public or sit on a jury if you are convicted of a felony. A third or subsequent conviction in ten years may result in increased fines, jail sentences and license penalties. You will lose your CDL for at least one year for the first offense for: (a) driving any vehicle under the influence of alcohol; (b) driving any vehicle while under the influence of a controlled substance; and /or (c) refusing to undergo blood alcohol testing. You will lose your CDL for at least three years if you committed any of the foregoing offenses while you were operating a CMV that is placarded for hazardous material. You will lose your CDL for life if convicted of any of the foregoing offenses for a second time. You may be prevent from entering Canada. - Amedio, Gerald: After a DWI, your first concern is keeping your license, but you will also face other potentially immediate and long-term consequences. Taking a close look at your situation, we will help you assess the possible criminal penalties, including fines, probation and incarceration. Even for first-time offenders, the fines can be severe. License Suspension In New York, if you refuse to take a breath test, your license is suspended immediately and automatically. The state has to give you a hearing within fifteen days of the arrest. If they decide that the police officer had probable cause, there is an automatic, six month license suspension, regardless of the outcome of your criminal case. We have never lost a refusal hearing and we will work hard to protect your rights going forward as well. It is also important to note that the only time you go before the DMV in a drunk driving case is if you refused to take the test. If you submitted to a breath test, your license suspension will be determined in court.
- Kurt Mausert: Did You Know...? ¥ The police have to have reasonable suspicion to stop your vehicle, and probable cause to make an arrest. If they don't, the rest of the prosecutor's case may fall apart. ¥ Field sobriety tests administered by the police are often unreliable. One study found that 46% of the population can't pass the standardized field tests even when they haven't consumed any alcohol. ¥ The hand-held breath test (Alco-Sensor) equipment police use at the roadside is not scientifically reliable. That is why it is not admissible in court as proof of intoxication. ¥ The Breathalyzer or Intoxilyzer equipment police use to measure blood alcohol content can be affected by a number of factors besides, or in addition to, your alcohol consumption. Arresting you is easy. Proving you are guilty is not so simple. Don't make it easy for the State of New York to take your driver's license away from you.
