Any delay on your part in unequivocally agreeing to take the test will
be considered to be a refusal and you will lose your operator's license
in the State of Pennsylvania for a period of one (1) year. The general
rule is that it would be in your best interest to submit to a chemical
test to determine your blood alcohol content when you are asked to do so
by a police officer that has stopped you for driving under the influence
of alcohol. Keep in mind there are always exceptions to this general
rule. Remember, you do not have the right to select what type of test
you will submit to. The arresting officer is the one who decides whether
the test will be a blood test, a breath test or a urine test. Avoiding the Worst Consequences
A first conviction for DUI will not usually involve jail time, depending on your BAC (level of intoxication) and whether there was an accident. But it puts your driver's license in jeopardy and sets you up for harsh penalties if you are arrested for drunk driving again within 10 years.
Many first offenders are eligible for Accelerated Rehabilitative Disposition (ARD) Ñ a pre-trial diversionary program that does not require the entry of a plea but allows you to keep the DUI off your public record and (usually) retain your license. If ARD is an option (it's up to the D.A.), Mr. George can advise whether you should accept it or fight the charges.
A second or third DUI means mandatory jail time, massive fines, license revocation and other serious consequences. It is critical to fight the charges, and you need an aggressive attorney who knows where the weak spots are Ñ and when to negotiate.
