Additionally, there may be a loss of drivers license for a lengthy period of time both as a result of a DWI conviction, and/or as a result of refusing to take a blood or breath test or taking a test that indicates more than the legal limit of alcohol in your system. You may also be required to pay several thousand dollars in surcharges over a three year period to keep your license after the suspension has ended.

- Hampton, Keith: Driving While Intoxicated The state of Texas leads the nation in alcohol-related motor vehicle accidents. Strict rules cover drinking and driving. Ready for immediate action When a person is arrested on a DWI charge, immediate action is required. Just 40 days after an arrest for driving while intoxicated (DWI), people so charged automatically lose their driver's licenses for a period of time. Fight the license suspension by immediately requesting a hearing or petitioning the court for a hardship license, which allows driving to and from work. The license suspension hearing must be requested within 15 days of the arrest. Other consequences of DWI Other possible consequences of an arrest or guilty plea to DWI, including: Up to 180 days in jail Probation for up to two years Fees to reinstate the license which can be up to $2,000 per year for three years Fines Community service Fees for car impoundment and towing Increased car insurance premiums The penalties are even more severe for second- and third-time offenders. Some defenses may include: Challenging breath, blood, or urine tests Cross-examining the arresting officer to assess for mistakes Special rules for minor drivers There is a zero tolerance law in Texas for drivers under the age of 21 who drink and drive. Minors with any sign of alcohol in their systems, no matter how small, are charged with driving under the influence (DUI). This is a much stricter rule than what is applied to an adult who drinks and drives. In that case, the amount of alcohol in the person's system must be above a prescribed level. Penalties can be: Up to a $500 fine 60-day driver's license suspension Up to 40 hours of community service Alcohol awareness classes Drivers age 17 and older who are stopped for drinking and driving with a blood or breath alcohol concentration of .08 or greater are subject to the same DWI criminal penalties as an adult. DWI with a child in the vehicle The rules are even stricter when there are children younger than 15 years old in the car. When driving while intoxicated, the driver can also be charged with the felony of child endangerment. The penalties are severe and can include: Fines up to $10,000 Jail sentence up to two years Driver's license suspension up to two years
